Purpose: To provide the Courier with a thorough understanding of the risks inherent in performing delivery services, including legal, physical, financial, and operational risks.
Effective upon acceptance, this Risk Disclosure Statement (“Statement”) is incorporated into the Courier Independent Contractor Agreement and the Courier Acknowledgment & Electronic Consent Agreement.
Courier acknowledges that participation in the Platform involves activities with inherent risks, including but not limited to:
Operating motor vehicles or bicycles in traffic
Loading and unloading cargo of varying weight and stability
Exposure to weather conditions, physical hazards, and environmental dangers
Interactions with third parties, including customers, vendors, or the public
Courier confirms that they understand these risks and that the Platform does not control or guarantee the safety of any activity.
Courier understands that using a personal vehicle, bicycle, or other mode of transport carries risks of:
Accidents causing injury or death
Property damage to Courier, third parties, or cargo
Theft, vandalism, or damage to personal or Platform-related equipment
Courier affirms responsibility for maintaining proper insurance, ensuring vehicles and equipment are in good working condition, and complying with all traffic laws and safety regulations.
Courier acknowledges that:
Income is variable and not guaranteed
Expenses, including fuel, maintenance, insurance, and taxes, are the Courier’s responsibility
Delivery requests may be limited based on demand or geographic location
No Platform-provided compensation is guaranteed outside of documented Proposition 22 or contractual earnings guarantees
Courier accepts that participation may result in financial loss.
Courier understands that delivery work may involve:
Lifting, carrying, or maneuvering heavy objects
Long periods of physical exertion
Exposure to inclement weather, high temperatures, or hazardous road conditions
Risk of assault, harassment, or other third-party actions
Courier agrees to follow all safety guidance, personal protective equipment requirements, and local laws. The Platform is not liable for injury unless expressly stated in writing.
Courier acknowledges that:
Legal obligations, including vehicle registration, licensing, and local permits, are the Courier’s responsibility
Platform-provided insurance may be limited in scope
Liability arising from third-party claims or cargo loss may be borne by the Courier
Courier agrees to indemnify and hold harmless the Platform to the fullest extent permitted by law.
By accepting this Statement, Courier affirms that:
Participation is voluntary
All risks, foreseeable and unforeseeable, are assumed
This Statement does not waive statutory rights but does confirm informed consent
